FDA Medical Device Classification Systems
If you’re developing or marketing a medical device, understanding its classification is the first step to determining the necessary regulatory requirements for FDA approval or clearance. The U.S. Food and Drug Administration (FDA) classifies medical devices into three (3) categories based on risk to patients, intended use, and level of regulatory control required: Class I, Class II, and Class III.
Class I – Low Risk
Description:
Class I devices are those with the lowest risk to users.
Regulatory Requirements:
1. Manufacturers must comply with General Controls, including establishment registration, device registration and listing, labeling, and good manufacturing practices.
2. Most devices qualify for exemptions from premarket notification (510(k)) and premarket approval (PMA).
Examples:
Bandages, surgical masks, tongue depressors, electric toothbrushes, plasters, handheld surgical instruments.
Class II – Moderate Risk
Description:
Class II devices present moderate risk and require additional regulatory controls to ensure safety and effectiveness.
Regulatory Requirements:
1. Manufacturers must comply with General Controls and Special Controls, such as performance standards, post-market surveillance, patient registries, and FDA guidance.
2. Generally, manufacturers submit a 510(k) premarket notification to the FDA to demonstrate substantial equivalence to a legally marketed predicate device.
Examples:
CPR aids, ultrasound, infusion pumps, surgical drapes, surgical gloves, pregnancy tests, blood pressure cuffs, powered wheelchairs.
Class III – High Risk
Description:
Class III devices are those that support or sustain human life, or are implanted, or present a potential unreasonable risk of illness or injury.
Regulatory Requirements:
1. Manufacturers must comply with General Controls and obtain Premarket Approval (PMA).
2. Manufacturers must provide scientific evidence to support safety and effectiveness.
3. Devices that support or sustain life, or prevent impairment of human health, typically fall into this category.
4. Manufacturers must conduct clinical trials to demonstrate safety and effectiveness.
Examples:
Implantable devices, deep brain stimulators, pacemakers, defibrillators, breast implants, heart valves.
FDA Reclassification Process
Devices may be reclassified to a different class when new information becomes available.
Process to reclassify a device:
1. Submit a reclassification petition to the FDA.
2. Provide evidence supporting the change in classification.
3. The FDA evaluates and may reclassify the device accordingly.
Reclassification can lead to a device being subject to less stringent regulatory controls if justified by safety and effectiveness data.
Regulatory Pathways
The pathway to market for a medical device depends on its classification.

1. Premarket Notification 510(k)
Required For:
Most Class II devices and some Class I devices with a suitable predicate.
Purpose:
To demonstrate that a device intended for marketing is as safe and effective—that is, substantially equivalent—to a legally marketed device (section 513(i)(1)(A) FD&C Act), submitters must compare their device to one or more similar legally marketed devices and provide evidence supporting their substantial equivalence claims. In this process, manufacturers commonly refer to the legally marketed device(s) used for comparison as the predicate. While devices recently cleared under 510(k) often serve as predicates, submitters may use any legally marketed device. Additionally, “legally marketed” means that manufacturers cannot use a predicate device that violates the FD&C Act.
Process:
a. Submit a 510(k) application to the FDA.
b. Provide data supporting substantial equivalence.
c. If the FDA agrees, it clears the device for marketing.
Please note that the FDA typically does not conduct pre-clearance facility inspections for 510(k) applications. Manufacturers may market the device immediately after the FDA clears it. However, manufacturers should prepare for the FDA to inspect their quality system (21 CFR 820) at any time following clearance.
2. Premarket Approval (PMA):
Required For:
Class III or devices not substantially equivalent to a predicate. Requires full clinical data.
Purpose:
To provide reasonable assurance of the safety and effectiveness of a Class III device, note that Class III devices support or sustain human life, serve substantial importance in preventing impairment of human health, or present a potential, unreasonable risk of illness or injury. Consequently, the FDA has determined that general and special controls alone cannot ensure the safety and effectiveness of Class III devices. Therefore, manufacturers must submit a premarket approval (PMA) application under section 515 of the FD&C Act to obtain marketing approval.
Process:
a. Submit a PMA application, including clinical trial data.
b. Undergo FDA review, which may include advisory committee evaluation.
c. If the FDA approves the application, manufacturers may market the device.
PMA represents the most stringent type of device marketing application required by the FDA. As a result, applicants must receive FDA approval of their PMA application before marketing the device. Furthermore, the FDA bases PMA approval on sufficient valid scientific evidence that assures the device is safe and effective for its intended use(s). In addition, this rigorous process thoroughly evaluates patient safety and device efficacy before the product reaches the market.
3. De Novo Classification
Required For:
Novel devices that are low to moderate risk but do not have a predicate.
Purpose:
Devices that manufacturers classify into Class I or Class II through a De Novo classification request (De Novo request) may be marketed and used as predicates for future premarket notification [510(k)] submissions, when applicable. In other words, the De Novo request provides a marketing pathway to classify novel medical devices for which general controls alone, or general and special controls, offer reasonable assurance of safety and effectiveness for the intended use, but for which no legally marketed predicate device exists. The FDA bases De Novo classification on a risk-based classification process.
Process:
a. Submit a De Novo request to the FDA.
b. Provide evidence supporting the device’s safety and effectiveness.
c. If granted, the device is classified into Class I or II and may require a 510(k) for future devices.
4. Humanitarian Device Exemption (HDE)
Required For:
Devices intended to benefit patients in the treatment or diagnosis of a disease or rare condition. These devices have reduced evidence requirements.
Purpose:
This exemption applies to devices designed to benefit patients by treating or diagnosing diseases or conditions that affect not more than 8,000 individuals in the United States each year. Specifically, manufacturers develop these devices to address rare medical needs that impact a small patient population.
Requirements:
a. Provide reasonable assurance of safety.
b. Demonstrate probable benefit.
c. Does not require demonstration of effectiveness.
